Complaints Regarding Content Posted on The Expert Knowledge Network
The Expert Knowledge Network is a media site for the distribution of content created by subject matter experts.  Under the terms of our User Agreement and Terms of Use, content must not violate the copyrights or intellectual property rights of others.  Furthermore, this includes the rights of anyone, regardless of whether those individuals are Users or not.  If you have questions about copyright law, intellectual property rights, or The Digital Millennium Copyright Act (DMCA) please consult with an attorney familiar with current law in your jurisdiction. 
In accordance with our User Agreement and these procedures, and regardless of whether The Expert Knowledge Network may be liable for any alleged violation of rights or inaccurate or unlawful content, The Expert Knowledge Network may remove or disable access to content appearing on the EKN website for any reason. 
Pursuant to the The Online Copyright Infringement Liability Limitation Act (OCILLA), Title II of the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512), The Expert Knowledge Network has established a takedown notice and counter notice procedure to protect the copyright and intellectual property rights of third parties and our Users as described in the following sections.
Disputes will be managed on a case by case basis and we will attempt to deal fairly with all parties but The Expert Knowledge Network retains the right to remove content submitted by its Users or Expert Users because it has been determined, in our sole discretion, to violate the terms of the User Agreement and Terms of Use.  For information about best practices in writing or producing original content please consult an expert in the field.  For specific questions regarding your legal rights please consult a legal expert in copyright and intellectual property law. 
Best Practices for Content Producers
Because The Expert Knowledge Network provides content distribution for Subject Matter Experts it is the responsibility of our Users, including Expert Users, to follow professional practices in regard to copyright and intellectual property right matters.  Your best defense against complaints is to exercise good production and editing standards, aspire to produce original content, and respect the ideas of others, offering citations when appropriate and avoiding the use of others original content except under current law for fair use.  If you have questions about what constitutes fair use please consult with an attorney familiar with current law in your jurisdiction.  Content may be subject to regulation in the jurisdiction or jurisdictions in which it is distrusted.  For information about best practices in writing or producing original content please consult an expert in the field.  For specific questions regarding your legal rights please consult a legal expert in copyright and intellectual property law. 
Procedures
The Expert Knowledge may make a good faith attempt to forward the written notification of copyright violation or infringement of intellectual property right to the User who posted the content or take other reasonable steps to notify the User that the complaint has been received.  That User may in turn file a counter notice refuting the original complaint and provide information that shows the original complaint is in error.  All complaints and counter notices will be handled on a case by case basis.  Our policies and procedures for removing or disabling access to content alleged to violate a third party’s copyright or intellectual property rights remain at our sole discretion.  It is also our policy to remove, disable or terminate accounts of Users who violate our User Agreement and Terms of Use for whatever reason, including but not limited to, violating third party’s copyrights, intellectual property rights, or submit content that violates any other provisions of our User Agreement and Terms of Use,
Please note that any notice or counter-notice you submit must be truthful and must be submitted under penalty of perjury.  A false notice or counter-notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice or a counter-notice.
CLAIMS REGARDING COPYRIGHT INFRINGEMENT
Notice of Copyright Infringement
If you believe in good faith that your copyright has been infringed, you may submit a written communication which contains:
1.    An electronic or physical signature of the owner of an exclusive right that is allegedly infringed  or the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and the name of the rights owner and if a person other than the rights holder has been appointed to act on behalf of the rights owner, the name of that person;
2.    A description of the work that you claim has been infringed.  The description should include basic identifying information such as title, author, date of publication or other appropriate identifying information appropriate for the type of content;
3.    A description of the content that is claimed to be infringed upon, preferably including a copy of the actual work;  and information specifying the location on our website of the content that is claimed to be in violation;
4.    The name, telephone number and e-mail address of the person making the complaint or other information reasonably sufficient to permit us to contact you;
5.    A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6.    A statement by you that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Counter-Notice:
If you believe that a notice of copyright infringement has been improperly submitted against you, you may submit a Counter-Notice, providing a written communication which contains:
1.    Your physical or electronic signature;
2.    Identification of the material removed or to which access has been disabled;
3.    A statement under penalty of perjury that you have a good faith belief that removal or disablement of access to the content was in error or that the content was misidentified;
4.    Your name, email address and telephone number, and a statement that you consent to the jurisdiction of the Federal District court in the judicial district of Caddo Parish, Louisiana or other Federal district as necessary.
